LANSING, MI (WKZO AM/FM) – The Michigan Court of Appeals ruled in favor of Enbridge Energy this week as the Canadian firm is in a legal battle with the state over its planned tunnel project in the Straits of Mackinac.
The court rejected the arguments from Native American tribes and environmental groups that the Public Service Commission didn’t consider the overall need for the pipeline when they approved the permits.
Enbridge had reached an agreement with former Governor Rick Snyder in 2018 to build the tunnel for a four-mile section of its Line 5 pipelines that are currently on the bed of the Straits and have been in use since 1953.
Governor Gretchen Whitmer and Attorney General Dana Nessel have been trying to get that prior agreement tossed.
